LEVY SANCTIONS ON RACIST POLITICIANS THE US AND EU URGED!

Once they were all stationed in South Africa but since those dark days of apartheid – racism and racist policies have mushroomed the world over!

Today it is official nationalistic policy in some countries to spearhead racism, racial and religious profiling!

And when this is done the damage to a society is far greater than can be envisaged!

We already have the war against terrorism and perhaps it is time for another war!

Not a war using weapons of destruction but a war targeted at politicians the world over who spearhead acts of racism and religious prosecution on minorities of the land!

The instrument I am referring to is a comprehensive travel sanction levied on each of these politicians no matter which country they originate!

This should be followed up with the freezing of their assets and bank accounts abroad!

It is time the international community stood together addressing racism, religious profiling and the displacement of minorities and defenseless communities by political mind games and brute force!

Both the US and members of the European Union have between them the hard and software to initiate this without delay!

This brings us to the question of the identification of racist politicians spurring venom of hate in their respective societies create turmoil and racial riots and displacement!

Whether this is in Somalia, Uganda, and Yemen, Zimbabwe or countries in the Asia Pacific region no one should be left unfiltered!

The US, the European Union have their respective diplomatic personal stationed and in each diplomatic enclave therein!

You have your respective attaches who can monitor the local media networks and a report therein compiled and submitted for immediate action!

It is time we handled these racist politicians in an international effort!

It will also prevent the same politicians speaking with a ‘warped logic, forked tongue and venom’ in domestic politics , but by some ‘inexplicable transformation’ (?) as ‘peace ambassadors and international statesmen’ in international forum!

These racists are no better than those who today target innocent soft targets and civilians be they in Bosnia, in Palestine, in Somali, Yemen, Iran, Pakistan the Arabian peninsula states, the African continent, North Korea, Myanmar or other South East Asian States!

BANK NEGARA - PROTECTING CONSUMERS OR THE INSURANCE INDUSTRY?

I am surprised that despite my highlighting of this issue in my earlier blog posting nothing has come out in a public statement from Bank Negara towards addressing a joint meeting of all stakeholders who will be affected by the outcome of the introduction of a ‘no fault claim’ proposal!

Bank Negara officials cannot be so stupid as not to know that public/consumer sentiments on the ground towards any radical change of policies affecting them will bring resentment, drastic opposition and a groundswell of dissatisfaction towards the federal government!

I say it would be suicidal and really stupid to also pretend that there is no such policy initiatives in the pipeline based on recent comments on the same by the authorities.

I am aware that many groups have requested for a briefing from Bank Negara but sadly this has yet to materialize!

Why the fear and why the uneasiness to facilitate a joint discussion with stakeholders and the civil society?

It is all part of good governance and accountability and public policy initiatives should always be transparent!

Is it because the insurance lobbyists and Bank Negara are in a sine biotic relationship of sorts?

Is it because this is another apparent way to protect the insurance industry and their players at the expense of Malaysian consumers and others who are also stakeholders holding various responsible portfolios on behalf those who will be affected by any change in the way this scheme operates!

We cannot pretend that there is no such scheme based on the 2010 budget speech!

If this is mismanaged this will hurt the Najib administration very badly at a time the Prime Minister is working at breakneck speed to bring the country’s constituents together with policies that will protect their rights and interests!

This must be handled right or it will hurt the PM’s prioritizing of consumers needs!

I must warn all parties that after over 37 years in consumer advocacy and public policy policing, I am aware of each and every trick and my humble advice to Bank Negara is to refrain from any acts or omissions that may be seen as being extremely cordial to the insurance lobbyists and their cronies at the expense of consumers!

Malaysia is not the US, Australia, New Zealand, countries that are part and parcel of the European Union where there are social safety nets and parachutes to protect consumers and accidents victims and families!

If I fail to receive a call from Bank Negara confirming a platform organized for the mutual discussion of this new proposal with all stakeholders, I will personally share my grievances and that of my colleagues nationwide to Prime Minister Najib Tun Razak!

This is not right Bank Negara!

Bank Negara must be seen with the consumers and their stakeholders who protect consumer rights not with the bourgeoisie cigar smoking rascals in silk suits - the ‘fat cats’representing the industry or worse their lobbyists!

ISA ARREST – WELL DONE HOME MINISTRY!

Most times we tend to be ungrateful!

Ungrateful that there are people out there sacrificing that we can walk a safe street, sleep a sound sleep and walk a sound walk in the parks with our family and children!

We take the security of the nation for granted!

So yes – I do not take lightly the unsavory comments that the Ministry of Home Affairs acted ‘unprofessionally or unsavory’ in arresting several individuals under the Internal Security Act!

Whether they are businessmen, politicians or even students, more so, foreign students here it is most important to remember that there is a ‘war’ out there carried out on soft targets!

And as I pointed out in my earlier blog posting urging, appealing our authorities to look at the serious gaps in our ‘Malaysia second home program’, others setting up tourist and tour companies here, we have some suspicious ‘tourists arrivals and repeat visits’ and certainly others claiming to be students arriving here!

There is enough material on sleeper agents and others financing and acting behind these terrorists groupings and it is not always what it seems!

There is no stereotyping of a modern day terrorists – he could be just anyone!

And there are enough materials on this if we bother enough to read instead of waiting to politicize each and every action of the Home Ministry undertaken unilaterally and in joint consultation and exchange of intelligence data and reports with others in the ‘war against terrorism!’

National security cannot and must not be compromised at the altars of ‘human rights platitudes or some one’s bull-shit politics!’

To claim that such moves to protect Malaysia undertaken by the Home Ministry is at the behest of western pressure or adverse influence in stretching one imagination towards the wild side!

In National security issues – such as these - only an absolute idiot will say that the ISA is a convenient tool to use to avert pressure by making foreigners, in this case mostly from the Middle East region, into scapegoats!

Are they suggesting that we float intelligence data all so freely complied at great costs and sometimes loss of lives by government operatives and undercover agents to appease them?

As far as I am concerned - Home Minister Hishammuddin Hussein has stated 10 people were held under ISA, which allows for detention without trial, for alleged terrorist links. He refused to divulge more information and rightfully so!

What was important was that they were alleged to be “involved in international terrorism” so the home ministry acted in the public interest!

And I am sure by now others if they are here will have fled!

As such - Malaysia must not release further information that could jeopardize the ongoing investigation.

As Hishammuddin Hussein stated  we are now dealing with international linkages, international terrorism, it cannot stop with just the people we apprehended because we do not know whose else is involved, who funds these operations and whether there are other sleepers around!

These days there many conduits, many groups, with great separation and non communication between sleepers and operatives as not to expose their operations if any in the various conduits are caught!

Many groups hardly know the other conduits involved except of the extent of their own operational issues!

But as the home minister said this is a good wake-up call because the playground for the terrorist is no longer one location.

We live now in a borderless world and the world has become the playground for these terrorist operatives!

In the meantime – I cannot but say – ‘Syabas’ to the Home ministry and our special task teams entrusted to address this menace and threat!

The problem in Malaysia is even the institutions set up by the government with all the necessary support and infrastructure and funding to assist people in dire straits become overly incompetent, bureaucratic and red taped!

The give the federal government a bad name!

Those working there become instant pencil pushing idiots!

When I go public or take this to the Minister personally in Putrajaya - they get upset with me!

But they fail to realize that Malaysia is not the ‘ketua Bahagians and Cawagans or the runners and greedy politicians running after government projects, Bangladeshi workers quota and ’surat sokogans’ so that they can continue living that luxurious and wasteful lives of pretense - trophy wives, fast cars, luxury houses, foreign trips, honorifics, positions in GLCs, cigars and silk suits - nothing wrong if they had worked for it but not this way!

This is because the majority of the 27 million Malaysians are reflected in the struggle of this person writing this letter to me!

She knows no politicians, MPs, Aduns or power brokers in Penang, just this simple man whom her family came to meet and developed a family orientated bond for over three decade after I addressed a land scandal in Bagan Seria in Perak those days!

So before I turn ‘green’ or do so - those of you in the PERKESO office in Kuala Lumpur, please do the needful!

The enclosed letter speaks volumes and need no clarification. It is unedited in content with only the name and address of the one grieving removed!

I know the family over 37 years from my Consumer Association of Penang (CAP) and Sahabat Alam Malaysia (SAM)days!

‘Dear Jacob Anan,

Many greetings to you.

I know knowing you – you will help if you can.

I am so fed-up with and grieved by this SOSCO people.

They did this to me last year and I had to go up and down to the SOSCO office in Penang so many times - taking annual leave and time off from work.

Thank GOD for one Ms. Chiam from SOSCO in Penang who kept calling SOSCO in the Kuala Lumpur office to help me.

I have already submitted all the relevant documents in time (as usual every year) to prove that I am a widow and Benedict (my only son) is still in College and yet they deduct my monthly SOSCO pension.

I am not rich. People think I am ‘rich’, even my own sisters because GOD gave me a heart that shares everything!

I am ‘rich’ in helping any one who needs help within what I have.

So relatives and others think I am ‘rich’ but GOD knows and my son knows how I struggle every month - living from paycheck to paycheck.

Since 2007 my pension has not increased a cent.

In 2007 - the increment was only RM36.97. My pay has not increased either.

I mentioned this to Mr. Paguman Singh of Sosial Security C. Sdn. Bhd., when he sent me an e-mail advising me to become a member of SSC by paying RM50.00 a year.

I paid once and after receiving only RM36.97, I did not think it was worth being a member.

I withdrew the second part of my EPF because Benedict did not get a scholarship for his degree course!

The price of everything has increased - so difficult.

I do not want SOSCO to deduct my SOSCO pension for just one more year.

Anan, I am sorry for crying to you. I know you have a good heart to help all who come to you.Please help me if you can. Below is the e-mail I sent to Perkeso yesterday.

AVOID UNHEALTHY FOOD AND BOYCOTT DIRTY RESTAURANTS!

AVOID UNHEALTHY FOOD AND BOYCOTT DIRTY RESTAURANTS!


In 2006, the Health Ministry then led by the proactive, non nonsense and visionary health minister, Dr Chua Soi Lek (above left) came out with a brilliant plan to meet non-governmental organization (NGO) representatives to work on a campaign to educate the public on the pros and cons of fast food.

His then concern was the food served by many of Malaysia’s fast food outlets and the damage they do to current and future generation of Malaysians!

Yes, lifestyle is a major problem and needs looking into!

He also warned the bottle drink industry on the excessive use of sugar and coloring!

I want to echo his concerns here and go a step further this morning as I call for a drastic comprehensive program or ‘War’ against Restaurants serving unhealthy food!

Even the need to call for a nationwide boycott of such restaurants!

We can start with that corner shop in your neighborhood!

That one which is on a 24 hour shift, workers all walking around like zombies, unshaven, clothes all dirty, preparing and handling food with one’s naked hands who only earlier was seen scratching their private parts, noses or worst areas disgusting!

A visit to their cooking area will also reveal how food is recycled, the area where food is prepared and cooked being dirty!

It is common to find rat’s aplenty, cockroaches and other strays within and in its backyard!

Look at the dishes and curries served and carry out a test on the level of salt, oil and fats therein!

You do not have to be a rocket scientist or a dietician - just walk in any restaurant popular for its nasi kandar, fried mee, roti chanai, nasi briyani or nasi minyak and check!

I am aware that there have been discussions on this – even - in the Dewan Rakyat recently where our parliamentarians were debating on advertising restrictions for fast foods claiming their detrimental effects on health of Malaysians but must I remind them that fast foods are not the sole culprits here!

So my call today is two fold!

I appeal to my friends in the Ministry of Health to familiarize themselves with the Food Act and perhaps hear my cry for the last twenty years for a ‘Food Handlers Act’ and in the meantime go do an unannounced walkabout cum ‘operasi’ on that corner shop!

I will bet you will find:

1. Food being prepared and sold in unhealthy and unhygienic conditions

2. Food handlers unshaven, in dirty attire serving food

3. Quality of meat, vegetables and other raw materials used poor.

4. Food being recycled: - example the friend fish, chicken or meat of yesterday today being sold as sambal fish, chicken or meat!

5. The level of fats and oil just unhealthy.

6. The environment of the said kitchen, drains, rubbish area all in filthy condition and this is where the food is cooked and prepared!

All of the above means only one thing – the aspirations and Food Act is unfulfilled!

Rather than hyping on stereotyping certain kinds of food, it might be useful to educate Malaysians on choosing their foods based on caloric content and reminding them of the importance of a correct food pyramid.

Food providers also do have a role in propagating good eating habits and enlightening their patrons on the nutritional content of their menu.

So I expect even the ‘Mamak shops’ notorious for the quality of their workers and food to be able to make such declarations!

More so when they exhibit the ‘Halal’ certificates so prominently while failing in pertinent areas!

Last friday - I was with the religious authorities in Selangor discussing ways to address all these issues to protect the rights and interests of consumers!

I will not hesitate to call for a nationwide boycott of all eateries that breach the fundamentals of the Food Act!

DOCTORS - PUBLICITY SEEKERS OR PLAIN SALESMEN?

Really I find it just vulgar and degrading of the noble profession - when these doctors just cannot these days (thanks to amendments on advertising) lay off making a nuisance of themselves by making repeated press statements and other publicity stunts  on so called ‘one discovery or another!’

From the claimed non invasive cure for sinusitis or heart surgery to various ‘detox procedures’ using coffee or what have you to various cosmetic face, breast and ass lifts - all which these days are carried in our mainstream media under ‘health columns’ with these individuals posed photos and of all things some in - that vulgar bow ties!

No one wants to be let out!

Just scan some of the local mainstream newspapers from time to time or ‘raki’ several private hospitals, clinics or health clinics mushrooming in several malls nationwide or ‘pushing and pimping’ some argument on ‘wellness!’

Worst, these days – they have also vulgarly gone into revealing the names of organ donors and using that to canvass for more funding!

All this to me is a criminal breach of one’s privacy and highly unethical!

But the same idiots would not call the same press to tell them that the recipient has died days after that so much media hype!

Even if that is done it will get a two liner in extremely small fonts and in the back pages!

Is this all part and parcel of how the medical profession should carry themselves?

Is this because our ENT fellas and others do not have much work anymore that they need to join the long queue of our medical practitioners who just cannot let their work and skills speak for themselves like the many doctors, lead surgeons and specialists that I know of who shy away from the media but just work themselves to the ground without any media hype or the usual song and dance!

Most importantly, allowing their dedication, commitment and sacrifice to speak for itself!

In fact, in my last meeting I shared this concern with Malaysia’s proactive and no nonsense, Director General of Health Services, Dr Ismail Merican who himself also is a dedicated and committed practitioner who has not forgotten his medicine nor the volumes of professional ethics that comes with it!

Dr Ismail always welcomes constructive criticism and any feedbacks that are conveyed to uplift standards, professionalism and ethics!

He has assured me that he will do something about this!

Let me just address one of the issues!

As far as I know from my sources abroad this non invasive procedure for sinusitis is nothing new!

In fact, if you remember our former premier also went for such a procedure and returned Australia - without anyone making a fanfare or fuss of that!

I just cannot understand the media fellas either!

Can they not address the many issues that need be in primary health care?

Why allow them and their newspapers/magazines to be used as tools for someone’s personal and private agenda under the guise of ‘medical breakthrough’ without first checking with senior medical professionals attached with our Ministry of Health on their claims before running any story!

Why give so much publicity to individuals, certain private hospitals and private profit and egoistic operatives - so much exposure?

How is the ordinary man/woman going to benefit from that story?

Is this concretization?

A PRAYER FOR A MUCH LOVED SULTAN!

LET US PRAY FOR THE JOHOR ROYAL FAMILY!

I am deeply saddened to hear of the death of our beloved Sultan Iskandar Al-Marhum Sultan Ismail of Johor!

I have only fond memories of my encounters with him during my undergraduate/post graduate and initial working and hockey days both while in Taman Iskandar and Taman Skudai Baru Johor, prior to and after graduating from University!

Some of those cheerful moments were certainly alongside the late Mohamad Rahmat (Tok Mat) and late Dr Tibbs Fernandez in company!

As far as I am concerned behind that ‘strict and deep voice’ were a very2 kind and loving Sultan and a man who just loved sports and his subjects!

He was always encouraging, benevolent and extremely generous!

My deepest heartfelt condolences to newly crowned Sultan HRH Tunku Ibrahim Ismail Sultan Iskandar and the royal family for the deepest loss!

LET US PRAY FOR HRH THE SULTAN OF JOHOR!

I am deeply saddened to hear that beloved Sultan Iskandar Al-Marhum Sultan Ismail of Johor is gravely ill and has been warded at the Putri Specialist Hospital in Johor Bahru today.

Let us all hold a prayer vigil and uphold him in our prayers praying for his speedy recovery!

He is a very loving and caring Sultan!

Let us also pray for HRH Crown Prince Tunku Ibrahim Ismail Sultan Mahkota (above left) who has been appointed as the regent of the state!

INSURANCE - ‘NO FAULT CLAIM’ BIG MISTAKE!(Part 2)

Yesterday Ms Alice George raised several pertinent questions pertaining to the possibility of drastic changes to the present structure of Mandatory Insurance coverage and payments!

And I was glad she did as it should be discussed on a wider platform than it has been done at the moment,

It was mind boggling and troubling - therefore I called up my intelligentsia to look at the issues, Alice raised.

In fact, only several days ago another friend, also a practicing lawyer had brain stormed on the same issue and its implications for consumers and law with me!

I am referring to the subtle attempt by the ‘back door’ to re-introduce drastic changes to various insurance schemes in Malaysia which includes the controversial – ‘no fault claim!’

Which of course is the brain child of the ‘insurance mafia and lobbyists’ in the country I am certain?

Charge high premiums but pay out less and claim it is done all for the sake of the consumers to save time, money, solicitors costs and prevent continued backlog of cases!

‘A win-win situation’- the proponents will say?

I am further troubled and have my reasons as I decided to read Bank Negara Governor’s keynote address at the financial industry conference 2009 on 17 November 2009 - 10 days before my birthday!

I am going to highlight the said paragraph and invite you to revert to me through emails or best call me to ascertain if you too felt the subtle maneuver of sorts taking place as we read in-between those lines?

I will go straight to the core avoiding the earlier discourse of colorful words, phrases, adjectives and references referring to ‘our financial standing as diversifies, broadened product offering, competitive, penetrative, strengthened governance, risk managed’ which may be highly brilliant in a paper presentation in our attempt to over sell ourselves but in my experience (all 36 years as a consumer advocate-gosh!)in today’s ‘market place blues’ – it is plain unadulterated poppycock!

But there was certainly that ‘pound of meat’ there as well that gets my mind and that of my financial intelligentsia all excited with repeated mental orgasms in suspicion!

That exciting paragraph is as follows:

‘In the insurance sector, greater competition will emerge from the

progressive deregulation of product rates. The current reforms in the

motor insurance sector will introduce far-reaching changes in a key

segment of the industry, with significant implications for the

business strategies of insurers and their approaches to risk

management. With the introduction of a new scheme for basic motor

insurance cover, pricing for non-statutory motor insurance will be

gradually liberalised, thus removing price distortions. This will

allow rates to adjust to underlying risk factors. This will also be

accompanied by a holistic review of motor insurance practices and the

supporting infrastructure to enable more scientific underwriting and

improve claims management. Industry groups have been formed to study

these issues and make recommendations for the smooth transition to

this new and more competitive environment, while at the same time

improving practices across the entire value chain of the motor

insurance sector. The groups have made good progress and the

recommendations are expected to be finalised for implementation in the

second half of 2010.’

Is the above paragraph very subtlety talking about the advent of the ‘no fault claims’ and other major changes changing the face of insurance protecting the industry at the expense of the victim/consumer’s long term interest?

I am of course also suspicious of the reference to the term ‘industry groups’ and clearly that these ‘industry groups’ are being formed to study and make recommendation?

Who are those in that ‘industry groups?’

Not,that I cannot suspect or speculate!

Is the wide cross section of stakeholders who will be affected also in that ‘industry groups’ that was cited?

I am referring to my friends in the legal fraternity (the Malaysian BAR), practitioners, legal advisers and consultants, members of the civil society, NGOs and most importantly - ‘a pain in the butt’ like me?

Will there be such a gathering to meet, discuss, debate, exchange price sensitive information and views in a exhaustive and comprehensive manner before introducing something as controversial as the ‘no fault claim!’

And more so - without holistic consultation and forcing it down our throats by brute force only to invite further controversy and community backlash!

Which in today’s political climate maybe destructive and embarrassing to the ruling elites and resulting in forced withdrawal in the public interest?

So to avoid such distress and embarrassment and the usual ‘roller coaster rides’ - may I suggest to the financial intelligentsia and bourgeois and my friends in Bank Negara – let all stakeholders meet – as Alice cited in a ‘open, transparent, accountable manner’ and bite, chew, peal through those contentious issues and most importantly for one – whether it is necessary and the right move in the first place to introduce the controversial ‘no fault claims’ or other drastic changes to the present insurance payout schemes in 1MALAYSIA?

TENANT FROM HELL KEEPING RESIDENTS OF PJ SS20/9 & 20/6 AWAKE!

Usually I ignore letters to me that are unsigned or without the name/address and mobile number!

But in this case I am willing to make an exception!

An exception because my children read the letter and were very upset when they read the last paragraph:

‘We desperately need urgent help. Please help us. Please send the right people to advice this tenant. You are our hope, we humbly beg for your help in ending this nuisance!’

My son Reuel said:

‘Dad I know the amount of pressure you are going through, your lack of sleep and rest but this was a plea from residents who have lived in that area for over 20 years in peace before a nightmare of a  resident came to live among them creating a public nuisance!

Dad you must give them your assistance!

Among the allegations against that ‘tenant from hell!’

He had numerous ‘sub-tenants’ and visitors of all ages and sexes coming in and out, there are at times over twenty cars driven in and out, to make matters worst there are wild and loud parties, mahjong sessions, shisha smoking, BBQs, loud singing and dancing  every other day including weekends ending up in the early hours of the morning!

According to the residents who wrote the letters they have also send a similar note to:

  1. Ministry of Housing and Local Government
  2. Majlis Bandaraya Petaling Jaya
  3. Suruhanjaya Syarikat Malaysia
  4. Kementerian Pembangunan Wanita, Keluarga dan Masyarakat.

I am told there have been police reports made and police cars have visited this house on numerous times but there is yet to be a cordial and peaceful solution to take into cognizance the rights and interests of other residents along SS20/6 and SS20/9 Damasara Utama, Petaling Jaya!

So this is to comfort the said residents that I am bringing this matter to the attention of the Police and the Ministry of Home Affairs!

I am also urging the residents to make a residents police report at the nearest police station and fax us a copy as well!

I will assure you that there will be an in-depth and comprehensive investigation of your grouses and action immediately taken!

I will also inform my friends in the media to highlight these complaints!

MANDATORY INSURANCE COVER - QUESTIONS FROM CONSUMERS!

CONSUMER - WHOSE INTEREST PROTECTED IN MANDATORY INSURANCE COVER? 


Dear Dr Jacob,

The Prime Minister in his budget speech last October 2009 indicated that the Government was to introduce mandatory insurance cover with expedited processing of claims.

Expedited settlement of claims is good.And the present approach of the courts to not allow postponements certainly will help achieve this.

However, it is also necessary to ensure that the amount of damages awarded is reasonable bearing in mind the injury and the effect of the injury to the accident victim(the injury may be so serious that the victim is unable to work and provide for the needs of his family).

No details have been forthcoming todate on the proposals of the Government.

My concern is that the Government may seek to follow some method used in other countries without taking into account the Malaysian situation. Methods that work in a welfare state are inappropriate for Malaysia. There, accident victims also have access to good medical and health benefits.

Further, the cost of education is taken care of. The same cannot be said for Malaysia as the public health and educational facilities have their own constraints.

Somebody has to ensure that the interests of accident victims and their families are safeguarded.

It is best that any proposal be discussed amongst all stakeholders in an open and transparent manner.

Any of us can be accident victims. So I request CASSA to seek to participate in these discussions and ensure that the interests of accident victims and their families are safeguarded.

I propose to write to the newspapers on the above. I hope that I can count on the support of CASSA.

1MALAYSIA STORE – ANSWER TO SUBSIDIES WITHDRAWAL!

 

I have repeatedly said that policy matters must be left in the hands of the professionals and not politicians!

Professionals to be read as those learned practitioners of the civil service in the policy divisions!

Politicians come and go and many do not look beyond trying to stay afloat and win in the next General Elections or worst to be retained by party for that seat and portfolio!

And that is the reason I keep saying we need to address the issue of subsidies with a sense of professionalism, direction and vision!

That there needs to be protocols put in place, persons appointed to drive, monitor and audit  it but more so after all the stakeholders in the Malaysian marketplace are roped in for a series of updates, policy deliberations and discussion!

That is the mark of professionals – the art of corporate and political governance!

So where are we really on the question of subsidies?

There was a lot of political hype that it was going to be done away with then we had rumors of about turn now we hear of roller coaster rides and leading to where and what position is anyone’s bet eventually?

We must remember that in every society there are the poor and the marginalized and these groups need assistance!

There is also that – ‘urban displaced poor and the challenged!’

At the same time we have learnt that some of those who claim to represent these groups are indeed crooks, thieves and have siphoned off the generosity of the government for private and personal greed and profit!

We know subsidized items have left for Thailand, Indonesia, Borneo even Singapore and right before the eyes and situational control of our various enforcement agencies!

But again just because we have had ‘Pagar makan Padi’ types in 1Malaysia we cannot withdraw in its entirety the rational in wanting to help the marginalized groups within!

First it is important to re-look at the various monopolies we have given out and it is time to change this!

Yes, that takes political guts and courage!

Do we still have political courage and guts today or is it of the past – meaning after the early 80’s – ‘tak ada lagi!’

We have become political Eunuchs – period, all hot air and no bite!

Bottom line monopolies do not help it encourages ‘high end corruption’ and that’s all!

Second it is important to safeguard the concept of subsidies in new form meaning having subsidies facilitated by a new protocol and with a series of inbuilt mechanisms for governance, audits, zero tolerance for abuse, seepages and corruption!

It is time to look at the Indian example of the ration card not that it has no faults but we can improve on that!

The government could have its own version and module of the ration card or identity card/Mycard (call that vehicle what you may!) with the price sensitive information inbuilt for the target group of beneficiaries of the government subsidies!

Various stakeholders and an inter-ministerial group could work on the protocols and guidelines!

I would advice the setting up of what I will call the 1MalaysiaStores nationwide with a comprehensive security system in place!

1MalaysiaStores will be stores set up by the government (if need be by selection or joint partnership with consumer groups or others) equipped with subsidized items and meant only for the poor and marginalized to patronize based on the identity/Mycard prints or for the matter electronic biometrics!

All 1MalaysiaStores nationwide will have computerized database and linked to the centre to check on the utilization, consumption patterns and identity of the patrons!

The household goods sold in these 1MalaysiaStores will be all subsidized and for use only by those having those specialized cards (the poor and marginalized) which will be provided for by the government nationwide based on means tests!

Consumer groups nationwide could also help monitor the 1MalaysianStores and provide feedbacks on further improving the system and reporting on any seepages or weakness that may be detected after a period of time in operation!


I intend to place a working paper on this with Prime Minister Najib Tun Razak on his return from Delhi after briefing my minister Ismail Sabri Yaacob, the secretary generals and the policy divisions!

HAITI EARTHQUAKE – LESSONS FOR MALAYSIAN POLITICIANS!

A week after the devastating 7.0 magnitude earthquake stuck Haiti and where Port au Prince lie devastated in ruins and their population injured, trapped or dead under huge concrete rubble aid is finally coming

Not a minute is wasted not one ringgit and there is no vital supplies sitting in some warehouse or politicians’ office waiting to be only given to party people or one’s own religious community as we have seen so often in Malaysia!

I should know as I was in Penang when the Tsunami struck Penang and set up the first investigative and communication setup at the then Casuarina Hotel, Batu Feringghi, using my wife’s laptop while many politicians ran away from the island and others played political mind games and worst behaved shamelessly!

A fact I communicated to the then PM when he visited Tanjong Tokong, Penang!

He was upset at that form of behavior and advised all accordingly!

I communicated also with the then CM as he arrived in New York!

But in Haiti – there is a difference, we see a kind of rapid response, there are no racist, religious heretics, politicians and warlords trying to high jack or even selective giving which should teach us a thing or two how social work is done free of political and racial discrimination!

It is really heartwarming to know that nearly a week after the devastating earthquake struck near Haiti’s capital, donations for relief efforts are still pouring in and now in excess of $200 million.

UN and Para Church organizations and bodies, charities, companies, individuals and celebrities across the U.S. have been rallying together in the aftermath of the 7.0-magnitude quake last Tuesday, and their efforts are paying off.

US President Barrack Obama has roped in two former US Presidents in the humanitarian effort despite past political differences and political divide - a far cry in comparison to our politicians in their Malaysian petty political divides!

That is not all - as - more than twenty-two companies which include General Electric, Microsoft, MSFT, and Coca-Cola have pledged $1 million or more a piece, according to the U.S. Chamber of Commerce.

For the record – 15% percent of total donations to the American Red Cross have been corporate gifts!

Even Hollywood is stepping up as well, with numerous stars at Sunday’s Golden Globe Awards sporting yellow, blue, and red ribbons to support Haiti relief, and urging viewers to donate which is brilliant!

One thing is certain no matter where there is devastation we always see the Americans there first assisting even as a nation they are struggling with a vulnerable economy where unemployment has increased despite all the economic packages!

The American people have always sacrificed and once again are leading in that struggle and May GOD REALLY BLESS AND PROTECT AMERICA!

GST - IS IT CONSUMER FRIENDLY?

Q1. How would the implementation of GST impact consumers in Malaysia?

A: Based on the limited and scattered information we have on the proposed GST, since the whole issue is still in ‘cloak and dagger style secrecy’ – there is already an impression that it is going to be the ‘Mother of all taxes’ to save the country of its many woes and problems but in that drive hurt the middle class and the poor of the land!

We are made to understand that it is a flat-rate taxation system which will affect all the players in the marketplace be they the rich or the poor on a level ground!

To us it means the impact will be highest on those who are poor. By imposing the GST, which is a consumption tax, you do not have to be a rocket scientist to say that the poor will become poorer.

This is because Malaysia has a large middle class and poor population who use their income on bare necessities for survival.

Poor/low-income households spend about 80% percent of their income on food, compared to 20 percent in higher-income households. The income consumption of the rich is lower; therefore their potential for saving is greater.

Their earning power has diminished over the years and this will further challenge their stressed and overdrawn financial position.

So by this figures you can see the middle and the poorer segments of Malaysia’s population will start as underdogs even before the tax hits the ground!

CASSA is certainly upset and peeved when those behind this GST formula have yet to understand this issue and worst, argue that price controls for rice, flour, oil, milk, sugar or subsidies to justify implementation of the policy.

This is utter nonsense and does not reflect the situation on the ground!

Q2. What are your concerns with regards to the implementation of GST in Malaysia next year?

A: Most importantly has there being enough discussion among the proponents of this tax and the various stakeholders in the marketplace and most importantly, heads of states, their financial advisers, business chambers, even those under opposition control?

The lack of transparency, accountability and the initiation of discussions between these players is a fundamental mistake which is going to create various controversies and a backlash against the federal government in the next General Elections!

We are still asking as to what is the design of the GST and its implementation and operational protocols but no answers are coming!

Q3. What are the factors that the government has to take into consideration when drafting the GST to minimize the negative impact on consumers?

A: It is obvious that this is a phrase change of the tax firmament by distributing the burden of taxation equitably between manufacturing and services. But in doing so we are going to burden a burdened Malaysia middle class and the poor who are already having to face a high costs for basic goods and services!

There needs to be discussion and we need to brief, update and drive this program through by convincing the over 27 million Malaysians and among them, the hardest hit middle class and poor that this is the answer and that they are going to benefit from this, which I certain they will detest as an embarrassment to their intellect and thinking!

The decision seems to be made by the political bourgeois in Putrajaya rather than after discussing with the hardest hit in the nation’s villages, estates and urban slumps!

Q4. What are the benefits or disadvantages of GST via a vis the current sales and services tax?

A: There are concerns of its effect on small enterprises.

Secondly consumers will ask - will this replace the present income tax and other taxes in the country including the toll or will it end up like the pole tax in England in the 80’s with the Thatcher years which created a backlash and caused that administration to fall!

As for the present sales and services tax it has already been proven that it was badly administered and abused and the victims were consumers!

But I must agree that a flawless harmonization of the GST laws across the board and states will help trade and industry.

Will there be a common procedure, levy, assessment, collection and appropriation and most importantly, dispute resolution mechanism put into place?

And who will head and drive it?

But to be fair there must be an exit provided for those who will be hardest hit by its implementation.

‘There is no doubt in my mind of the sin-biotic relationship between certain bank officials and the syndicates and their operatives!This has been going on for far too long at the expense of Malaysian consumers!’ - Dr Jacob George 

WHY HIRE PURCHASE ACT 1967 IS ABSOLUTELY VULGAR!

This is real! This is a nightmare for several decades and despite the outcries from Malaysian consumers many gave lip service that the said vulgar act will be amended but nothing came out of it!

Again we are hearing voices to that effect!

But let us look at a classic case of the operations of the Hire Purchase Act 1967!

Razak Abdullah bought a car at RM92, 0000.00! The loan was about RM70, 000, 00

For the last three year he has serviced his loan but after being retrenched his loan repayments though not seriously violated became irregular.

He received a letter from the said bank saying the following:

Take notice that the Bloodsucker Bank, who is the owner of the above hired by you under the agreement dated 24/01/07 intends to retake possession of the goods after the expiration of 21 days from the service of installment unless:

  1. the arrears due on overdue installments  RM 2,856.00
  2. the interest due RM30.13

All totaling RM2, 886.13 are paid on or before 18/01/10

In default you are liable to pay the sum of RM144, 803.50

For the record the borrower has already paid the sum of RM71, 990.00 to date.

The vehicle is worth less than RM60, 000.00 today!

Now what nonsense is this?

But that is the reality and there have been incidences where rude care repossesses or should we say - thugs are employed to intimidate and recover the vehicle but there are cases where they even settle for pocket money allowing the borrower to go until the next confrontation with the same!

If the car is repossessed and if it is a value buy syndicates are all arranged by bank insiders especially those in the second car dealer’s trade and commissions change hands after price sensitive information is given on the auction price!

So I am glad that Domestic Trade, Cooperatives and Consumerism Minister Ismail Sabri Yaakob (above left) saying that vehicle owners can expect better protection against unscrupulous financial institutions once the proposed amendments to the Hire Purchase Act are approved by Parliament this year.

I am glad that he has agreed with me that the existing law was seen as being too much in favor of financial institutions with minimum protection for consumers.

He was also aware of the rude car repossessors appointed by financial institutions.

He is aware that there are cases where these thugs were harassing car owners even for being a day late in paying the vehicle loan monthly installments.

Consumers were also subjected to other forms of abuse even after their vehicles had been repossessed and auctioned.

We all know this is where the real nightmare begins as the car will be sold at an unreasonable low price and burdened with other exorbitant fees levied on the borrower.

The end result is the borrower ends up owing the financial institutions despite having their car sold!

All over the world banks are under scrutiny for dirty deals and dealing!

Ask US President Barrack Obama who is cleaning up this vulgar, corrupt and arrogant sector in the US!

For far too long we have heard whispers and rumors how syndicates have penetrated banks and in other cases where connected politicians, their lackeys and others in the group of ‘subsidy mentally Incorporated’ (SMI) are abusing the system.

Innocent housing loans clients losing their homes after failing or due to delayed loans payments in amounts below a few thousand while the sharks of politicians and members of the SMI despite taking loans in the millions for ‘projects’ are not tackled the same way as innocent housing loan victims!

Where there are proclamation of sale and brokers and syndicates are given price sensitive information prior to make the bit thanks to sine biotic relationships between bank operatives and the syndicates and in other cases where non performing loans are sold enbloc to private companies who then make a killing at the auctions and the rewards shared at the expense of the owner!

I am highlighting herewith a classic letter of such a practice and invite your comments and feedback so that IF this is happening in Malaysia – we can take the necessary steps by first making a police report, following up at the commercial crime, calling for a press conference and blowing this sky high?

Copy of this letter was given to me.

Several days after this notice was given the borrower a senior law enforcement man dedicated and decent man was informed his home was to been auctioned over a back loan of RM4, 800.00

I spoke to the both ‘Bloodsucker 2’ and ‘Bloodsucker 3’ to call off the auction as this borrower would be coming over with the said monies as he was ‘protecting a VVIP on tour’ but both was extremely arrogant and refused to help.

A (H1N1) VIRUS MUTATION STATEMENT – LIOW SHOULD SHUT UP! (Part 1)

Can someone medically qualified, perhaps Malaysia’s Director General of Health Services, Dr Ismail Merican or friends at the World Health Organization (WHO) in Geneva or CDC, please enlighten me as to the statement from Malaysia’s worst health minister, Liow Tiong Lai which is highlighted in many Main Stream Media (MSM) today!

All I need is a simple and straight forward answer!

Who is Liow Tiong Lai to state that there are no signs of A (H1N1) virus mutation in Malaysia?

When I am advised that there is ‘real concern’ on this the world over!

The operative word to me is – ‘virus mutation!’

He is a just a politician, Malaysia’s health minister and a ‘worst one’ at that!

Was that statement made as a result of an in-depth comprehensive investigations and research?

Was that the result of the findings of a top notch research team that had conducted a series of medical protocols, intensive tests, investigation and research and come away with that finding?

Even then – according to protocol and in-view that it is a medical statement it should have come from the Director General of Malaysia’s Health Services!

But that statement did not come from DG Dr Ismail Merican did it?

It did not because I am certain Malaysia has not undertaken any comprehensive research in this area to cite such a preposterous statement!

That is not the only foolish statement that was made at the same press conference!

Let us look at another which appeared!

Liow is reported to have stated:

‘the ministry would receive 400,000 doses of vaccine this year, and these would be administered to front liners and those in the high-risk groups, such as obese people, pregnant ladies, and patients suffering from high-blood pressure and chronic illnesses.

“These people can come forward to government hospitals next month to receive the vaccine if they want to,” he said.’

It is true that the health ministry will receive 400,000 doses of vaccine in 2010 and according to protocol these would be administered to front liners and essential services!

But Liow seems to have extended an open invitation to include obese people, pregnant ladies, and patients suffering from high-blood pressure and chronic illnesses.

And if Malaysians 26 million decides tomorrow to flock or stampede to our government hospitals requesting that they receive the dosage there will be pandemonium and another crisis in a country known for creating ‘crisis after crisis’ due to political oversight and expediency!

I am certain many of those monitoring these issues would remember the ‘chaos’ that was created in the initial months the A (H1N1) scare took place thanks to a rumor that free ‘Tami Flu shots’ were available at Sungai Buloh and Selayang hospitals!

There was chaos and security had to be called and secured and what an unnecessary episode in a hospital setting!

Liow should know better as to what are political statements to make and what are medical statements and others related to medical policy which my learned mind says should always come from a medically trained and exposed person and in this case, the Director General himself!

As I have indicated before Prime Minister Najib must initiate a major reshuffle of the Cabinet and one of the portfolios that needs a major change is the Health Ministry!

RISING PRICES AND WITHDRAWAL OF SUBSIDIES – DEMONSTRATIONS NOT THE ANSWER! (Part 1)

These days everyone wants to claim to be ‘consumer advocate’ and in fact if it was initiated knowing well the fundamental issues, I have no grievances!

But when politicians and others having had no experience in consumerism or the track record begin to address these issues, I get uneasy!

More so, when they threaten street demonstrations as part and parcel of sending a message to the Ministry of Domestic Trade, Cooperatives and Consumerism and the Federal Government!

Let me update these my friends and thank them for their concern but let me reiterate also that in the National Consumer Council most of the lead consumer organizations are present and several of us including this writer have direct access not only to my minister and the proactive ministry team from the hardworking KSU and downwards but also to the office of the Prime Minister!

We are looking at the issue diligently and in a professional manner!

We are addressing the lacuna and irregularities in the market place brought about by abused subsidies and price controls.

We are looking at marginalized and the poor in the country and how to solve their interest with precision and equity without compromising tenets of the free market system!

We are looking at the market players and among them those enjoying monopolies!

We are looking at the world markets and international prices of commodities including oil and analyze its trends and impact on our shores!

This writer has declared a war against those enjoying monopolies and my feedbacks and grievances have been forwarded to the policymakers.

We are working on a full basket of issues with apples, oranges, coconuts and jack fruits!

After years of abuse finally the team at the National Consumer council led by the no nonsense Minister and the hardworking and caring but strict KSU and Team proactive are addressing these issues!

These things take time!

Many hours leading to late nights with the competent policy division is the regular exercise!

There are datelines and benchmarks put into place and we must be patient and allow this process to take root and bring forth fruits!

This is not the time for it to be politicized and abused and become fodder for anti government spins or personal and private political agenda!

Please do have respect for us in the National Consumer Council – we are not politicians but dedicated, caring and concerned individuals looking at the entire basket of issues.

So my plea is please – Hands Off on this matter!

And my belief is strictly – demonstrations and malicious attacks are not the answer to the needs of the Malaysian consumers at the marketplace!

Please let us do our work free from political intervention and added pressure!

DISCLOSURE OF ORGAN DONOR NAMES UNETHICAL!

I am shocked, disgusted, angry, appalled at the blatant disclosure of the name of a hit-and-run victim who consented to the donation of her organs to the Sultanah Fatimah Specialist Hospital in Muar.

No doubt, the sacrifice of the donor resulted in the opportunity afforded to four beneficiaries to benefit from the transplant of the donor’s lung, kidney and liver. There is, however, a policy in regard to donors that must and should be upheld by policymakers and the media.

I am aware that public affairs in Malaysia today has become a matter of `song and dance’. We have become a nation of pretenders, takers and users, hypocrites one and all, even using the `dead and dying’ for our political spin, to uplift our dying political image, careers and future after being exposed for the rogues and rats that we are!

Those in the medical profession - such as operating surgeons, doctors, physicians - are not exempt from expectations that they carry themselves in decorum and poise.

It is thus disgusting and unethical when these same people violate what I consider to be three of the most cardinal rules to be adhered to in relation to organ donations:

(i) The non-disclosure of the donor’s name;

(ii) protect the donor family’s right to privacy and

(iii) avoid highlighting displays of magnanimity by public figures such as ceremonies to hand over their mock cheques - the money often does not belong to them.

Is it because organ transplant have become big business now - listed in certain stock markets abroad?

Or is it because it’s just another way to gain honorifics, grants running into millions, new social stature, the opportunity to rub shoulders with politicians and the other rich and powerful of the land?

But at whose expense and to fulfill whose needs? At what costs to the donor, donor family, privacy and ethics?

They must stop immediately!

There are many operating surgeons in the country who have been putting in their `heart and soul’ into dedicated service without fanfare. They follow strictly their profession’s code of ethics, which seems to have been lost on some of those now in the profession?

Let us keep our hospitals and, in particular, the good deed of donors, free from media spin and the hands of publicity-hounds.

This will be among the issues I will raise when I meet the health director-general Dr Ismail Merican.

I am happy to know the majority of those who have either pledged or donated their organs are Non Muslims!

I have no problems in media stories highlighting the need for donors or press statements urging or reporting on the present state of organ donations in the country!

I am delighted to know we have managed to get 18 kidneys, a heart, six livers, 20 heart valves, 25 corneas, three skin and nine bones!

I am happy to have discovered, for example, that:
- in 2009, 39 people donated their organs, of whom 20 were family-initiated (an improvement from previous years)
- between 1976 - 2009, 271 people have donated 571 organs and tissues in Malaysia
- 137,556 people have pledged their organs. Of the donors, 74,354 were women
- Selangor tops the list with the highest number of organ pledges at 27,951, followed by Johor (23,871), Penang (19,737), Federal Territory (18,457) and Perak (16,992)
- of those who donated, 153 were Chinese, 71 Indians, 16 Malays and the rest of other races.

I wish also to congratulate the hard-working people at the Health Ministry’s National Organ Transplant Resources Centre.

INTOLERANCE, RACISM AND DOUBLE SPEAK GETS US NO WHERE!

MALAYSIA 2010 MUST MOVE AWAY FROM EMERGING RACIST TRENDS!

We live today in a borderless world where former international law caveats work no more!

For example (above), it would be stupid for the Sri Lanka bourgeoisie to tell the world it is domestic politics stay out of Sri Lanka affairs - when the United Nations and others question them on atrocities and war crimes committed in the film footage where semi naked, gagged and tied up ethic Indians are shot dead by men in Sri Lanka army uniforms!

Evidence for war crime tribunal do you not think?

On the same note - speaking about the sad absence of statesmen in a country!

Every time a former leader of a certain nation speaks, out comes sarcasm, warped logic, bitter and racist statements girded as if it was a new form of nationalism!

They forget this is 2010 not 1969!

Whether the statement is in the corridors of respected senior physicians at a well known hospital, to a bunch of journalists working for the country’s leading racist newspaper or immediately after a book launch the damage is the same when picked up by the international media !

It is a pity that certain people cannot hide their sense of inferiority, mental insecurity, fear and of short comings when faced against political giants and international statesmen like Singapore‘s dynamic corrupt free senior Minister Uncle Lee Kuan Yew (above left)  or proactive US President Barrack Obama!(second)

These Malaysian racists remain arrogant and politically stubborn despite destroying the organs of a country’s institutions and redefine vulgarly new form governance where there is no more the separation of powers with all being subservient to their political will and might!

With their political and sociological hang-ups they continue to attack the British ignoring the sacrifices and contributions of the West and the British in this land!

Sad that even our former Prime Minister, the decent and patient Abdullah Ahmad Badawi, who I admire and respect, is not spared of their venom!

But the same people have no hang ups having pariahs like African madman and dictator, Robert Mugabe as friends!(above left)

They have no hang ups about paying millions to private contractors to secure an audience with a US President?

Racist and hypocrites!

If this was not enough challenge - we have a number of self proclaimed NGOs lead by ‘political wannabees’ individuals who certainly have political ambitions screaming and demonstrating causing fear and anxiety among peace loving Malaysians!

It is sad how ‘far from the tree’ of the founding fathers, we have fallen!

When I first went into consumerism in the 70’s in Penang, I had two brilliant teachers and ‘father figures’ teaching and encouraging me on!

When I was wrong they taught me what was right and when right, despite the challenge or attacks, I faced, they stood by me like the ‘Rock of Gibraltar!’

Both taught me to address issues without fear or favor, without social religious or racial bias!

‘The truth will set you free – Jacob’ they said and added ‘if anything needs to be done it must be done today – do not wait!’

For the record, both are committed and devout Muslims and Statesmen, I love and respect Papa Idris and Uncle Fazal to this date!

As a legal, diplomatic and intelligence specialist, I need to advice all that the recent terror attacks against the Christians is a blot in this nation’s history and if the hand of ‘political adventurers and racist’ become the footnote and hold of Malaysian political governance – Malaysia will pay a dear price from the international and investing community which may include sanctions and the freezing of the bank accounts of our political elite in foreign and neighboring lands!

A very high price indeed and an ingratitude to those who dedicated their lives a service to the nation, those who pioneered the nation’s administrative and diplomatic services, the infrastructure, the education, health, agriculture, the armed forces, the police and civil service!

Is this how we repay them? Let us never forget their suffering and dedication!

Let us not allow a few ‘fanatics, racist bloggers and political pretenders destroy what we have built over 53 years!
