It is clear with ‘these amendments’ a monopoly is being created and legislative powers given that will protect concessionaires behind this monopoly as against the rights and interests of all consumers!

It is clear that this section with others will pave the way forward to introduce the controversial AUTOMATED ENFORCEMENT SYSTEM (AES).

And what is the said AES?

You do not have to be a rocket scientist to know that a concession will be given and perhaps two crony companies chosen to introduce car registration number plates with ‘chips’ which will cost RM150.00!

Today the cost of changing a number plate is below the RM40.00 mark!

With over 25 million vehicles (estimate) in the country this will be a brilliant profiteering act running into billions for the concessionaire and their political masters while the consumers are royally screwed!- Dr Jacob George

CONSUMERS SAY ‘TAK NAK’ TO AES! FAHAM TAK?

The Consumers Association of Subang and Shah Alam Selangor (CASSA) puts on record its protests against several amendments to the Road Transport Act 2010 which is to be tabled at the next Parliament sitting!

The changes if carried through will initiate a backlash against the said ministry and policymakers behind the said move.

It is shocking that policymakers have not learnt lessons from past similar attempts to force through draconian legislation that challenges and threatens fundamental human rights and choices that consumers have.

Among them the creation of monopolies to serve certain political and business partnerships and interest, higher fines and jail terms as if the intention is to ‘criminalize each and every road using Malaysian!’

If the proposed changes are not challenged it will bring great misery, misfortune to Malaysian consumers but at the same time make billionaires of those given certain intended ‘concessionaires on car registration number plates’ at the expense of fair trade and will rubbish and make a mockery of the Competitions Act 2010!

CASSA views that the proposed changes too drastic and would be rejected by consumers and politicians from both political divide which will put the federal government in bad light!

Let us examine just a portion of the controversial changes to the said Act to be initiated to help us understand why we protest the said changes!

1. Section 2 (b) – Definition of Roads

By deleting the words “but shall not include any private road, bridge, tunnel or anything connected to that road which is maintained and kept by private persons or private bodies” - we will have a situation in Malaysian where all roads be they those administered by the government, local council, our Kampong and estate roads all becoming under the said jurisdiction and any offence on them will be penalized by fines and jail terms!

Section 4A – “Notwithstanding anything contained in any written law, any police officer or road transport officer shall exercise the powers conferred by this Act in respect of offences committed under this Act on any roads maintained and kept by private persons or private bodies” – this basically means the enforcement officials can enter any road private or otherwise and summon the alleged offender!

This will have a major impact on villagers, estates, housing estates and the rural areas of Malaysian and its residents!

For example the next time you put up a tent for a prayer session, wedding, and a funeral at your housing estate road - you can be penalized!

That will be the state of affairs!


2. Section 13A and 14 – RTA 2010

And what is the said AES?

You do not have to be a rocket scientist to know that a concession will be given and perhaps two crony companies chosen to introduce car registration number plates with ‘chips’ which will cost RM150.00!

Today the cost of changing a number plate is below the RM40.00 mark!

With over 25 million vehicles (estimate) in the country this will be a brilliant profiteering act running into billions for the concessionaire and their political masters while the consumers are royally screwed!

This will bring about groundswell of backlash when the traders in this trade selling the RM40.00 version affected by this move which will threaten their profession and rice bowl!

What about ‘privacy issues’ pertaining to personal and private data contained in the said chip?

3. Section 58A – On notice on change of address

If you change your residential address you are to give notice of the said change failing which a fine and a jail term awaits you?

Once again, what are the intentions of the legal draughtsman behind this irresponsible change?

Are we trying to criminalize each and everyone by this change?

This is ridiculous and utterly stupid!

4. Section 38 – “Endorsement of suspension, revocation or disqualification” of a driving license.

Extremely draconian and where natural justice is affected! Why jail terms and fines of not less than RM3000/- or more than RM10, 000 and jail terms of 3 years. Interestingly if passed we may have more by-elections when state assemblymen and Member of parliaments are affected!

5. Section 48 – Another fiasco.

The above will have far reaching impact against Malaysian consumers!

Basically laws are there to control, assist, concretize the masses but not as an agent to create fear and anxiety and bring chaos in the hearts and minds of the society!

CASSA appeals to the Members of Parliament to reject the said bill and serve the interests, rights of the consumers!

It must be stated that here we are addressing the road transport and not serious sexual crimes, robbery, corruption, murder or those relating to drugs and so forth.

Only an absolute idiot will say that the answer to the growing accidents in the country is higher fines – RM1000 to RM3000.00 and jail terms!

Only an opportunist will again use statistics on accidents to introduce the AES system which will be another monopoly like all the other monopolies we are dishing out at the same breathe saying that subsidies to the poor and marginalized must be withdrawn!

CASSA appeals to those behind these changes to withdraw the said bill for further deliberation and discussions among various stakeholders.

To drastically push the said Act will be a great and grave political mistake and one that will come to haunt all politicians seeking reelection in the forthcoming general Elections!

MALAYSIA’S LEAD TAMIL NEWSPAPER - MALAYSIA NANBAN TODAY CARRIED A FRONT PAGE STORY ON THIS SCANDAL!

MAN CLAIMING TO BE TAMIL NADU CM’S ‘RELATIVE’ CHEATED US OF MILLIONS!

His name is Baladevan Theaivendiram, his Identity card number - 540614-10-5729, a 58 year old Malaysian and he had claimed that he was a relative of Tamil Nadu Chief Minister Dr Kalaignar M. Karunanidhi through marriage claiming his nephew Singaporean G. Aravindan was married to the CM’s daughter Kanimozhi.

With these claims and that he was ‘politically connected’ to the ‘powers that be’ in Delhi and Tamil Nadu which includes the Railway Minister, senior official of the Railway Board, the management of IRCON International and that his brother worked as ‘special officer’ to a former Works Minister he is alleged to have duped individuals, contractors and companies over more than RM5 Million over the last 10 years saying that he was in a position to offer them various contracts in the Seremban to Gemas (103km) Double Track Railway project and 3G Telecommunication licenses!

He had also used a RM2 company called Zen Bridge Sdn Bhd in some of the said dubious transactions.

He also claimed to have paid several hundreds of thousands of ringgit to the said policymakers to facilitate these approvals which included expensive branded watches, pens, jewellery and suits.

On receiving these complaints CASSA conducted an exhaustive investigation into this scandal.We had personally visited New Delhi on three occasions and met the Minister, senior Railway Ministry Officials, the Managing Director and his top management team at IRCON International.

We had showed them all the various documents, thumb drives and other price sensitive information and raised many pertinent questions seeking indeed if this ‘Baladevan’ was associated to them!

They denied having any knowledge of this ‘Baladevan’ whatsoever!

CASSA therefore advises all those who have been cheated by this conman to lodge Police reports and to contact us to seek legal and other assistance in this matter.

CASSA has set up a hotline at 016-3261700 for this purpose. All feed backs will be kept highly confidential.

A third party has also come forward to offer a reward to any one who would provide vital information that will lead to the arrest and conviction of ‘Baladevan’ who has financially ruined the lives of more than twenty seven individuals!

Meanwhile CASSA also asks the Indian government and the Malaysian Ministry of Transport to investigate the following in the public interests:

1. Who gave him that confidential letter of award for the Seremban to Gemas Double Track Project between Malaysian and India? This was a government to Government initiative!

2. How did he get control of the total designs, specifications, drawings, pricing of the entire Seremban to Gemas project which he attempted to sell at RM5 Million at one time but had no takers and which he showed various contractors to convince them?

3. Who gave him the two letters to Malaysian companies claimed to be Ministry of Railway’s Railway Board letters?

4. Who gave him that ‘stinging letter’ written by Ircon International Managing Director to Malaysia’s Transport Minister?

5. ‘Baladevan’ repeatedly used the name of one Indian official – ‘A.P. Misra’ so who is AP Misra? What is his role in all these allegations? Is he also a victim or a player?

6. ‘Baladevan’ could not act alone without assistance from ‘individuals in Delhi and Chennai’ and the Government of India must do its part to ascertain that they conduct exhaustive investigations leaving no stones unturned!

CASSA will soon brief both the Malaysian Prime Minister and newly minted Minister of Transport on this matter.

CASSA will urge the Malaysian government to seek clarifications from New Delhi and Chennai on these allegations.

ROAD TRANSPORT ACT 2010 – CONSUMERS SCREWED - CRONIES TO BENEFIT?

It is quite clear that a major and drastic change is going to take place with the amendments to the Road Transport Act 1987 which if unchallenged will bring great misery, misfortune to Malaysian consumers but at the same time make billionaires of those given certain intended ‘concessionaires on car registration number plates!’

The amendments I am reliably advised is expected to take place at the next Parliament session unless public sentiments and protest forces major changes to a plot that has already initiated!

My view is that the said proposed changes to the act is far too drastic and would not be welcome by consumers nationwide and politicians from both political divide and put the government again on a defensive mode and repeated ‘political fire-fighting!’

WORLD CUP – KEEPING THEM HONEST!

There were no two thoughts about this!

Watching the earlier US game I felt that everything seemed to go against them.

There was no doubt in my mind that that idiot of a referee stole the US victory the other day and to make matters worst a linesman this time disallowed another goal on Wednesday!

The football mafia must be hard at work with millions in bets awaiting and some paying the black economy millions to make certain some teams win not by skills or being the better team but by the decision of those who have sold out the game!

As such – I realized watching the game with my family and praying hard for a victory for the US Team – not that I knew any of them but I felt a strange strong feeling of comradeship with the US Team and by far with this young man called Landon Donovan!

He was a great figure for the US for all things fair and right!

So there was just 3 1/2 minutes left in their World Cup and in one of the most stunning turnarounds in World Cup history, Landon Donovan scored on a lightning fast counterattack 45 seconds into 4 minutes of injury time.

With that the United States beat Algeria 1-0 and reached the World Cup’s second round!

But what touched me and I am certain the millions who watched the press conference post match by this young man was his faith, sincerity and truthfulness!

He was in tears and even 30 minutes later his eyes watered and voice cracked as he talked about the goal.

But this caught me as I am certain it did others:

‘Let me tell the ’self righteous’, the puritans among us, those high moral bashers and hypocrites that it is just not about  betting and gambling but the well entrenched and syndicated human trafficking of women, children (for prostitution), human trafficking of men, money laundering, drug trafficking and even terrorism-related activities!

DECLARE WAR ON THE BLACK ECONOMY GOVT URGED!

Though some quarters put the figure of the “black economy” in Malaysia to around RM10bil, I believe through discussions with my intelligentsia that the figure is far higher and around the region of RM57 Billion!

And as such join the chorus urging the government to address this matter before the ‘underworld and its black economy’ govern the nation directly, indirectly or through proxies as we have seen in several Latin American countries and the African continent!

Let me tell the puritans among us, those high moral bashers and hypocrites that it is just not about  betting and gambling but the well entrenched and syndicated human trafficking of women, children (for prostitution), human trafficking of men, money laundering, drug trafficking and even terrorism-related activities!

So therefore the time is right for the government to intervene and declare an all out war against this black economy and the various high powered figures behind them!

I must congratulate my dear friend and Home Minister Hishammuddin Tun Hussein (above left) for driving this action without fear or favor!

I must also congratulate dear friend Mohd Bakri Zinin (above) the Director of the Criminal Investigation Department for a job done well!

It is because of their dedicated, professional and vigilant efforts that we have had several recent successes in our war against the black economy!

But for this to continue and to succeed with the arrest of the ‘big fish’ - we need to provide vital feedbacks and intelligence to the ‘boys in blue’ and this must be done professionally and with speed!

We need to work closely with our ASEAN friends, INTERPOL, the FBI and Scotland Yard as it is the concern of all and it can only be addressed with success if there is cross border cooperation, intelligence gathering and sharing, joint operations and networking!

We need to work with the financial institutions and others who can provide ‘expert opinion’ on money transfers, on the money trail and other modes used!

PENANG GOVT - WHO LICENSED STUDIO 69?

Do the laws in Malaysia allow such activities that are presumed in my legally trained mind - a public nuisance to continue right to the early hours of the morning?

Are there no laws to prevent the patrons who are mostly teenagers and young Muslim women from consuming alcohol and according to allegations all forms of stimulants, ecstasy tablets and other soft and hard drugs?

Why was the Batu Feringghi Police hesitant to respond to hundreds of calls from both local and foreign tourists and the management of the said hotel to this nuisance? - Dr Jacob George

PENANG GOVT - WHO LICENSED STUDIO 69?

the block seriously affected by the nuisance!Studio 69 is left of this building!

Have you or your family ever being kept awake from 11pm right to 4am with loud intolerable music, DJs and the loud screams of drunk and drugged women screaming and their men howling literally?

Screams and more and more screams fill the night and early hours that frightened my young ones asleep!

The hotel management unable to do any thing but repeatedly complain to deaf ears and compile a huge file on patron complains and offer reduced room rates or even change rooms and free meals to angry and irritated customers!

They have done well under the circumstances!

No, not a page from Wolf man 2 but a reality!

Yes, it is shocking despicable, unruly, an eyesore, a classic example of the presence of organized crime networks at work and worst, a public nuisance and certainly questions and allegations of organized crime and of corruption in enforcement circles can be raised!

These are not just my feelings but that of many local and foreign tourists (from West Asia, the Gulf countries, Australia, Holland, Indonesia, Germany, England, Spain, Singapore, Hong Kong, South Africa) who stayed at Holiday Inn Batu Feringghi in Penang who spoke to me recently during my stay there!

Now more pertinent how did a single storey building in Batu Feringghi  attain their license to operate a club with such intensity music right next to hotel rooms where local and international tourists stay?

Are there no laws to enforce, guidelines on single storey bungalow and building as such which are converted into a high density and octave noise producers?

Do the laws in Malaysia allow such activities that are presumed in my legally trained mind - a public nuisance to continue right to the early hours of the morning?

Are there no laws to prevent the patrons who are mostly teenagers and young Muslim women from consuming alcohol and according to allegations all forms of stimulants, ecstasy tablets and other soft and hard drugs?

Why was the Batu Feringghi Police hesitant to respond to hundreds of calls from both local and foreign tourists and the management of the said hotel to this nuisance?

The Police cannot deny as I certainly made several calls myself and waited for them to show up as I walked into the Studio 69 premise in the early hours observing each and every action of the operators and patrons!

They never arrived when I was out there in the early hours - for more than 3 hours!

But all the same - it was despicable more so when these young girls were then ‘vomiting and falling all over’ the place which includes the abandoned stalls by the side of the entrance as eagerly waiting boyfriends or ‘customers’ trying to push them into their cars and some refusing to enter!

Their ‘clothes were falling apart’ and it was not a pretty sight!

These were young pretty Muslim women and it was a pity that my immediate call to a high ranking Police officer’s mobile went unanswered!

I spoke to these girls while helping them to clean up and learnt aplenty!

But Penang’s Batu Feringghi is fast becoming like other places - a site of ‘syndicated crimes and criminals’ and I will address this with my dear friend, Home Minister Hishamuddin who tolerates no such nonsense.

There are many illegals and foreigners also doing all kind and nature of business without detection!

Why?

I managed to speak to the Police the next day and they tell me of the lack of manpower as they cover a rather large area!

They apologized.

I do feel sorry for them if this is indeed true and will take this up with the command center in Bukit Aman and with IGP Musa Hassan.

I will also alert my KPDNKK Enforcement Units to stop ‘pussy footing’ as well and detain all those in violation of the trades mark or copyrights laws of the country whose business flourish in the Batu Feringghi walk ways!

It is going to be a tall order as this is indeed syndicated and all the players carry ‘walkie talkies’ to alert them of any purported move by the authorities or may have well paid informers alerting them of impending raids!

More so why these raids must come from out of state organized by a task force known to be clean to the core and success orientated!

But for now my call to the Penang government is close down Studio 69 in the public interest!

I will send a personal SMS to Deputy Chief Minister who is a friend and trust he will initiate much needed action!

If that fails I will have no other alternatives but to send my TV friends to do an undercover sting operation to cover this nuisance and interview the local and foreign patrons!

‘New Delhi and Tamil Nadu CM must be also embarrassed to talk but India too has her fair share of the corrupt using public office to enrich themselves and their families!

This issue if unsettled will cause severe embarrassment to the Indian PM when he visits Malaysia in October; the Malaysian press will certainly ask him many a question about this matter and also give him a copy of all that we have uncovered!

RAILWAY DOUBLE TRACK - SEREMBAN TO GEMAS CORRUPTION FIASCO CONTINUES!

Baladevan Theaivendiram is on the run now.

Another contractor contacted us and he claims this scumbag who is a disgrace to ‘all and sundry’ which includes his family had also demanded cash worth RM350, 000.00 for a portion of the contract involving the fencing and landscaping.



“He gave us the designs, pricing and other price sensitive information. He promised us to take us to meet the Indian Prime Minister and present and former Minister of Railways, India who he claims is his personal friend. He claimed to be a nephew of the Tamil Nadu Chief Minister too.

We were told to put the monies with a lawyer in Subang Jaya and we did but suddenly my partner needed the money for another deal and we had to take it out.

He came with another person called ‘Karim’ who claims to be Tun Mahathir’s nephew!

They also claimed doing another deal with the Pulau Besar Oil Storage project worth hundreds of millions but we were not interested!

It was the same time we were alerted to your blog from our friends in high office in Malacca and we are really thankful we were saved the embarrassment and financial ruin!

That you for alerting us and saving us! May GOD bless you brother!’

So it cannot but be a major scandal involving more than RM2 Million now!

How many more people are there who have yet to contact me perhaps too embarrassed to say that a two piece unemployed who speaks “Queens English’ cheated them as he did others – which has become his way of life and one that he will be made to pay for by the Malaysian authorities sooner than later!

Even thieves have honor but not this bastard!

Chennai and certain Indian officials are totally embarrassed how they allowed an unemployed trickster and conman to come into contact with them and to hold those private lobbying for the 3G telecommunication license where millions of under table monies were promised for ‘introductions’ and ‘lobbying!’

Baladevan Theaivendiram played out not only his family but close friends and others who gave him an opportunity to come clean and good in his 58 miserable year of birth but ‘old habits’ die hard what more how can a pathological liar, trickster and conman change from an habit he has so grown to be accustomed to – cheating people!

But these questions need answering:

1. Who gave him that confidential letter of award between Malaysian and India?

2. How did he get control of the total specifications, drawings, pricing of the entire Seremban to Gemas project which he attempted to sell at RM5 Million at one time but had no takers?

3. Who gave him the two letters claimed to be Ministry of Railway’s Railway Board letters? (see Blog posting part 4 on this subject)

4. Who gave him that recent letter written by Ircon International Managing Director to Malaysia’s Transport Minister?

5. Who is A.P. Misra and what is his role in all these allegations? Is he also a victim or a player? I will be meeting AP Misra soon perhaps he will reveal all so that justice is done!

I am certain in the course of police investigations both here and in India all these matters will be pursued and revealed leaving no stones unturned!

Delhi must do its part and seriously too if she does not want to lose out on future deliberations!

In the meantime, scumbag and rascal Baladevan Theaivendiram will celebrate his 58 birthday living a miserable life and one cheating innocents on 14 June 2010!

But the possibilities are there too that he may spend that day in a Malaysian jail!

My reasoning very simple if you want the private sector to be the engine of growth then you need to address issues they face for them – ‘time is of the essence – time is money’ - because as far as I am concerned the public sector has failed to inspire, excite, rejuvenate or simply move forward as they are obese, incompetent, slow, in comatose and there is far too many inconsistencies and duplication within!

We have the record of the largest civil service per population at perhaps 1.45 million?

We have created duplication and multiples of it and thus today this sector is unproductive and too politicized with their numerous - Pengarahs, Timbalan Pengarahs, Penolong Pengarahs, Ketua Penolong Pangarahs and what have you!

If this is not enough we are now creating more and more - ‘Public Commissions or Suruhanjaya’?

And they are headed by retired politicians and civil servants with very high salaries and perks and why?

BASIC WAGE - ANOTHER FLIP FLOP!

 



It is rather sad and distasteful that we have backtracked on our pledge to enforce a minimum-wage policy for security guards starting July 1.

In fact, as I indicated in my television interview on Astro Awani (live) on the eve of Prime Minister Najib Tun Razak’s launch of the 10th Malaysian Plan in Parliament that the time is upon us to initiate and introduce minimum wage across the board in Malaysia!

How can we move forward if we continue renewing and extending the contracts of those who are in leadership positions who have simply failed to energize proactively or transform the system and long past retirement age frustrating the younger and more open minded down the tier?

All these ‘old farts’ are good at is at apple polishing!

Coming back to this issue - there has been far too many decades we have been having a policy sucking up to the investors and employers and this MUST END!

You do not need mental Viagra for this just plain honesty, dedication, commitment and a heart that feel the pain for the marginalized among our community of workers!

I fully agree with my learned friends that this sudden freeze of implementation allows the numerous employers in the country to continue exploiting their workers with a meagre RM300 to RM400 wage a month!

What is worst is that this flip flop is a another reversal against the Human Resource Ministry’s National Wages Council’s recommendation in 2008 that wages for the estimated 150,000 security guards be set at between RM500 and RM700.

When I meet the Minister next I must ask him the real reasons for this major turn about that is an embarrassment to governance!

The pertinent question is was the plan reversed again because the ‘fat cats of industry’ appealed to him?

There is no excuse this time around for this flip flop as the industry and others had been studying the minimum wage proposal since 2004, and thus industry players had ample opportunity to provide vital feedbacks!

I am really disgusted because this whole matter was given prominence and hope after an announcement by the Minister of Human Resources himself in April that the minimum wage for security guards would be raised to between RM1,100 and RM1,450 monthly following the enforcement of the new policy.

The reason was also justifiable as the cabinet I am told felt this move was a means of encouraging locals to take up the job to replace foreign security guards, currently estimated to be 40,000 strong.

For the employers to say they need at least six more months to resolve issues involving private firms, government-linked companies and the government is absolute rubbish!

It is elementary - if the wages go up then the government too must pay higher wages per security guard they use in their many government ministries across the country!

I am embarrassed by this move and I do not know about others?

So we are finally told that a retired Israeli judge Jacob Turkel will lead an inquiry into the Israeli raid on the Turkish ship Mavi Marmara, in which nine people were killed.

The Israeli government says that they are going to establish an independent public commission that would be headed by individuals who are totally impartial, who are not connected with the executive branch and an investigation that would reach the highest international standards which if true, is welcomed!

True - Israeli commandos rappelled down to an aid flotilla sailing to thwart a Gaza blockade on Monday, clashing with pro-Palestinian activists on the lead ship in a botched raid that left at least nine passengers dead.

There seems to be testimony and video evidence that extreme violence was used and there was also activists armed with metal rods, knives, slingshots and two pistols snatched from the troops.

We have seen pictures of bloodied passengers and soldiers sprawled on the deck and troops dived into the sea to save themselves during several hours of hand-to-hand fighting that injured dozens of activists and six soldiers.

In Malaysia some journalists also claimed they were robbed and their credit cards and hand phones stolen! There are claims that they have evidence of a ‘master list’ which they took from one of the soldiers that had names of those the Israelis killed?

In other words, his alleged statement means this was premeditated murder and it was a hit!

Maybe this Malaysian journalist will be also called to give evidence at the said inquiry since his statements were carried in the Malaysian mainstream media!

We need to be accountable and no one should be on ‘a frolic of their own’ and for ‘personal agenda!’

PENGHENTIAN MONOPOLI SEGERA DALAM BERKALAN – CASSA!

Persatuan Pengguna Subang dan Shah Alam Selangor (CASSA) hari ini menggesa kerajaan menghentikan monopoli dalam berkalan dan dengan serta merta meliberalisasikan sistem Permit Import (AP) bagi tiga barangan kawalan iaitu gula, tepung gandum dan minyak masak (berasaskan kelapa sawit).

“Ini adalah jawapan untuk menyelesaikan masalah berkalan dan menggalakkan persaingan sihat antara peniaga-peniaga sekaligus memecahkan  monopoli oleh empat syarikat-syarikat tertentu,” kata Datuk Dr Jacob George Presiden CASSA.

“Masa dah juga sampai untuk pihak kerajaan membuat perubahan polisi dengan permit import barang-barang makanan khususnya gula, tepung gandum dan minyak masak yang sepatutnya dilkendalikan oleh Kementerian Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan (KPDNKK) kerana kementerian berkenaan menjaga kepentingan pengguna di Negara ini,’’ tegasnya.

Dr Jacob berkata bahawa pada masa ini Kementerian Perdagangan Antarabangsa dan  Industri (MITI) adalah bertanggungjawab untuk meluluskan Permit Import gula dan tepung gandum manakala Permit Import untuk minyak masak adalah di bawah Kementerian Perusahaan Utama, Perladangan dan Komoditi. Natijah daripada itu, keadaan ini menyulitkan KPDNKK untuk menyelesaikan isu-isu berkaitan bahan-bahan kawalan yang membabitkan pengguna.

“Daripada siasatan terperici CASSA dan perbincangan diplomatik dengan masyarakat akar umbi, kita berpendapat bahawa strategi kita untuk meliberalisasi Permit Import bukan sahaja mampu mewujudkan persaingan sihat di kalangan industri bahkan mampu memastikan bekalan bahan-bahan berkenaan mencukupi di pasaran,’’ tegasnya sambil menegaskan bahawa industri gula kini hanya dimnopoli oleh empat kilang sahaja.

Melalui pelaksanaaan langkah itu, Dr Jacob berkata, kerajaan berupaya mengurangkan bebanan pembiayaan subsidi yang ditanggung oleh kerajaan selama ini. Selain itu, ini dapat memastikan bekalan berkenaan benar-benar untuk kegunaan isi rumah dan bukannya untuk kegunaan komersial atau diseludup ke negara-negara jiran.

Dr Jacob juga berpendapat bahawa wang yang dapat diselamatkan oleh kerajaan boleh digunakan untuk kebajikan rakyat seperti meningkatkan pembangunan pendidikan, kesihatan dan prasarana luar bandar serta kawasan-kawasan pedalaman.

Sehubungan dengan itu, KPDNKK juga telah melaksanakan penguatkuasaan lesen kepada peruncit yang menimbulkan rasa tidak puas hati di kalangan peruncit, Dr Jacob berkata. Bagi menangani isu tersebut, beliau telah bertemu dengan Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan, Datuk Seri Ismail Sabri Yaakob serta pegawai-pegawai kanan kementerian bagi mencari jalan penyelesaian untuk semua masalah ‘stakeholder’ dalam pasaran dengan cara ‘proactive!’

Dr Jacob juga perpendapat peniaga runcit bukan penyebab utama kepada punca penyelewengan bahan-bahan saperti gula, tepung gandum dan minyak masak.

Dr Jacob difahamkan bahawa gula diseludup ke negara jiran seperti Indonesia dan Thailand kerana harganya adalah lebih tinggi berbanding di Malaysia. Sebagai contoh harga gula di Thailand dijual sebanyak RM2.37 bagi setiap kilogram manaka di Indonesia RM2.66, Singapura RM3.26 dan Filipina RM3.03 berbanding RM1.65 di Semenanjung dan RM1.75 di Sabah serta Sarawak oleh sindiket-sindiket besar yang mengadungi kuasa ‘orang atasan!.’

“Untuk membendung masalah ini, agensi-agensi penguatkuasaan sewajarnya melaksanakan tanggungjawab mereka dengan lebih berkesan dan efisyen lagi dalam usaha memastikan aktiviti penyeludupan dan ketirisan dapat dibendung.

‘’Kawalan lebih ketat perlu dilaksanakan di negeri-negeri yang bersempadan dengan negara-negara jiran,’’ katanya.

LESEN DIBERI PERCUMA DENGAN TEMPOH 5 TAHUN

Dr Jacob juga, setelah melibatkan diri dalam satu perbincangan khas dengan Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan, Datuk Seri Ismail Sabri Yaakob serta pegawai-pegawai kanan kementerian, merayu supaya penguatkuasaan Lesen Runcit yang diumum oleh KPDNKK mestilah dilaksanakan tanpa mengenakan sebarang caj kepada peruncit! Di samping itu, Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan, Datuk Seri Ismail Sabri Yaakob serta pegawai-pegawai kanan kementerian juga bersetuju dengan cadangan yang diutarakan oleh Dr Jacob.

Tambahan pula, Dr Jacob berpendapat bahawa lesen yang dikeluarkan itu juga mestilah percuma, mempunyai sah tempoh laku selama lima tahun dan pembaharuannya dikendalikan secara automatik kecuali peruncit berkenaan melakukan kesalahan di bawah Akta Kawalan Bekalan 1961.

Hal ini demikian kerana, pada masa ini peruncit dibebankan dengan 9 hingga 11 jenis lesen untuk menjalankan perniagaan (pendaftaran perniagaan, lesen premis perniagaan, papan tanda perniagaan, kebakaran dan keselamatan, lesen penimbang, alkohol, beras dan gas). Peruncit juga terpaksa menanggung kos sebanyak RM1,107 bagi tujuan pembaharuan lesen-lesen berkenaan pada setiap tahun.

Pada masa yang sama, Dr Jacob merayu kepada KPDNKK memantau dengan ketat punca ketirisan bahan-bahan kawalan ini dari peringkat akar umbi iaitu dari peringkat kilang, pemborong dan pengguna.

Dr Jacob mengalu-alukan KPDNKK untuk bertindak dengan lebih tegas terhadap isu yang kian berleluasa ini dengan menarik lesen pemborong yang didapati bersalah menyorok bekalan gula atau berkalan lain dengan senarai hitamkan syarikat terserbut!

Dr Jacob juga bersedia menjadi ambasador ataupun penasihat khas dalam strategi mengatasi masalah yang dihadapi oleh semua ‘stakeholder’ dengan KPDNKK. Dalam pandangan Dr Jacob, yang penting sekarang bukannya cara mempolitikan perkara terserbut atau membuat ugutan!

Semua piihak mestilah berkerjasama untuk mencari satu penyelesaian keseluruhan atau holistik kepada semua supaya hak pengguna sentiasa dibela dan dipelihara!

THIRD PARTY INSURANCE REVIEW - SAY NO NAJIB’S GOVT URGED!

GOVT URGED TO REJECT BANKS NEGARA’S FROLIC INTO THIRD PARTY INSURANCE CHANGES!

CASSA also rejects the intention of Bank Negara to set up a new company with government involvement and funding!

Is the real intention of Bank Negara in pursuing this matter of setting up a new company to control and play a role in it directly, indirectly or by the appointment of a retiring Bank Negara official (s) on the board of such a structure and entity with vulgar salaries and perks?

Does Bank Negara want the government to fund this new company at a tune of over RM500 Million per year as majority shareholder with the industry playing a token role?

The pertinent question then is why should the government get involved?- Dr Jacob George

The Consumers Association of Subang and Shah Alam Selangor (CASSA) today accused Bank Negara of going on a ‘frolic of its own’ and spearheading their ‘own private interest and agenda’ in proposing drastic changes to the present third party insurance scheme.

Based on CASSA’s comprehensive study and ‘meet the community sessions’ throughout the country, which includes, rural communities in the estates, villages, new villages and in Sabah and Sarawak, it is clear, that there is widespread anxiety and anger at Bank Negara’s frolic into third party insurance schemes.

What are presently needed in the system are more insurance companies being legally required to provide third party coverage ‘as a national service’ and at a cost that is fair and reasonable.

This is only fair and reasonable in view of huge vulgar profits these companies make in other sectors of the insurance schemes!

There is also a need for insurance companies to speedily make payments after court judgments instead of frustrating the course of justice by delaying tactics, more bureaucratic red tape and for appeals!

These actions by Bank Negara also damage the proactive changes and speedy resolution of court cases by the present Chief Justice!

CASSA also rejects the intention of Bank Negara to set up a new company with government involvement and funding!

The Consumers Association of Subang and Shah Alam Selangor (CASSA) today accused Bank Negara of going on a ‘frolic of its own’ and spearheading their ‘own private interest and agenda’ in proposing drastic changes to the present third party insurance scheme.

Bank Negara has claimed that the amendments are necessary for the following reasons:

1.     Ensure availability of basic protection to motorists

We are told that at end-2009 there were approximately 10.8 million motor insurance and takaful policies issued by insurers and takaful operators.

We are told that comprehensive policies make up 67.2% (7.24 million) of total policies issued while third party policies make up 32.8% (3.54 million)

We are told that the majority of comprehensive policy owners were owners of private cars. For third party policies, majority are motorcyclists!

As far CASSA is concerned all of the above 4 reasons are blatant misrepresentations and misleading.

And such we want to address each of the above radically!

Both one and two are available today and as it stands there is no necessity whatsoever to make any changes.

What is however necessary is that we have more insurance companies providing third party insurance coverage at reasonable rates to consumers.

We now ask why the need for an additional top-up is.

Whose rights and interests are being met by this top up?

Is this not profiteering?

How will Malaysian consumers in the target group of the lower income and the poor afford an additional ‘top-up?’

Will this not further create a consumer backlash against the federal government?

Will not the federal government’s MPs and State Assemblymen face the brunt of the backlash in the various political constituencies?

Bank Negara claims that for every RM1.00 paid by consumers Insurance companies are paying out RM2.67 as claims!

In other words, the state of Insurance companies in this country according to Bank Negara is one of loss and soon by that contention we will see most, if not all insurance companies going bankrupt!

As far as CASSA is concerned this is again a blatant lie!

Why is Bank Negara just citing third party insurance claims when the whole question of insurance covers many lucrative and profitable areas which reap in billions of profits?

Is this RM1.00 referred to by Bank Negara, the entire premium paid by consumers or only a portion of the premium paid?  If it is only a portion of the actual premium paid by consumers, then Bank Negara has again misled the public.

Anyway, in return for the billions they make as profits from other sectors of insurance, is this not a way of giving back something to the Malaysian society?

This could be the Insurance Company’s national service.

Secondly we ask two pertinent questions:

1. Are Insurance companies really on the brink of losses and bankruptcy? If so – are they prepared to open their financial books for us to appoint an independent panel of accounting experts to conduct an exhaustive and comprehensive investigation into their financial state?

2. We need to look at their salary structures and fringe benefits, perks, bonuses to see if really they are financially suffering. That there are no leakages, seepages and over salaried officials in the sector!

3.  We need to assess if there has been massive retrenchment and salary cuts taken across the board as well.

4. Most importantly if the insurance sector is indeed losing money, why is there a lobby for more insurance licenses to be distributed?

Is Bank Negara really articulating the grievances of the Insurance industry or going on ‘a frolic’ for their own private agenda?

Bank Negara has gone on record to say that they will facilitate redress between 2 to 4 weeks!

This is a mammoth misrepresentation and a blatant lie!

For redress, we need to ascertain fault and to determine fault, we need police reports and secondly to determine injury, we need comprehensive medical reports and based on the present track-record only an absolute idiot will say that we can determine both in a fast track procedure within 2 to 4 weeks!

Another important question raised is why the need to restructure motor policies when the present proactive changes brought about by Chief Justice Tun Zaki is addressing this issue admirably!

1. There are designated courts to address this matter.

2. We have mediation

3. Guidelines on awards have been followed through conservatively unlike awards in the US or the European Union!

So what is the ‘real issue and motivation’ on the part of Bank Negara here?

Today, I accuse the Central Bank of misleading the nation and in particular, the Prime Minister!

The Central Bank instead of addressing issues that we have from time immemorial brought to them like the irresponsible behavior of banks, bank charges, the ‘black hands’ working with third parties in foreclosures, the repossession of vehicles, credit card fraud and its profiteering charges, involvement in abandoned construction projects is spending far too much time and resources on an issue which is an non issue!

What about taking steps to reduce the existing leakages in the insurance industry - for example, motor repair claims been settled by insurance companies at exorbitant amounts?

What about fast tracking redress for clear cut negligent cases where there has been loss of innocent lives instead of haggling and appealing and ultimately frustrating the rights and interests and of true justice for the victim!

Does Bank Negara have an ulterior motive in spearheading this restructuring!

Is the real intention of Bank Negara in pursuing this matter of setting up a new company to control and play a role in it directly, indirectly or by the appointment of a retiring Bank Negara official (s) on the board of such a structure and entity with vulgar salaries and perks?

Does Bank Negara want the government to fund the new company at a tune of over RM500 Million per year as majority shareholder with the industry playing a token role?

The pertinent question then is why should the government get involved?

How is the government going to explain to the masses in Malaysia that while they are asked to forgo their subsidies here, we have a classic case of Bank Negara inducing a subsidy scheme!

The supposedly loss making part of the motor insurance claim is taken over by a Government owned company while the profit making part of the motor insurance claim is retained by insurance companies.  Who is Bank Negara trying to help?

I wish to warn and point out that consumers will never accept such a change which serves in my contention the interest of the insurance industry and the central Bank’s cronies!

For this reason and this reason alone, CASSA appeals to the Prime Minister and the Ministry of finance to reject the Central bank’s attempt to serve private interest rather than that of over 27 million Malaysian Consumers!

The present system is working and as such, there is no need for the government to get involved or initiate radical changes that serves not the poor, marginalized and grassroots communities.
